R.W.E. v. A.B.K. and M.K. 2008 PA Super 253
*This is not a Criminal Law case, but is interesting nonetheless*

Topic: Child Paternity

Summary: Where a father has claimed paternity of a child when he is aware that he may not be the biological father, he may not later claim fraud and attempt to rescind the acknowledgment of paternity.

Illustration: The father knew at the time of birth that there was a 50-50 chance that the child was not his. He chose not to have a paternity test done and acknowledged the child as his. The court held that the father could not later deny paternity when he knew there was a chance he was not the father and acknowledged paternity anyway.
