Texas legislators are currently considering a law that would permit police to conduct sobriety checkpoints.
Under the proposed law, law enforcement agencies would be required to follow specific guidelines when conducting a checkpoint. These guidelines include prior advertisement of the checkpoint, a limit to the number of checkpoints in a given area per month, a limit to the amount of time the checkpoint may be conducted, a set pattern determining which cars are stopped (for example, one out of every 3 cars), and a limit to how long each car would be detained.
Although past attempts to permit sobriety checkpoints have been defeated, many believe that this bill has a strong chance of being passed.
