On December 8, 2008, Allegheny County Common Pleas Court Judge Jeffery Manning found former Pittsburgh Police Officer Sean Deasy not guilty of homicide by vehicle while under the influence. Deasy was convicted of involuntary manslaughter and driving under the influence. Deasy was driving 72 mph in a 35 mph zone when he lost control of his vehicle and collided with a utility pole. Deasy’s blood alcohol level was between 0.11% and 0.13% after the accident. Judge Manning found that the Commonwealth did not prove beyond a reasonable doubt that the accident was the result of Deasy’s alcohol consumption.
