The Kentucky Senate Judiciary Committee has approved a bill that would enhance the existing DUI law. Under the proposed law, anyone found with a detectable level of an illegal drug or a legal drug without a valid prescription could be convicted of DUI. Additionally, the blood alcohol level needed for enhanced punishments would be lowered from .18% to .15%.

In the existing law, a person must be under the influence of a drug to the level that it impairs her ability to safely operate a motor vehicle. Senator Ray S. Jones argues that this “loophole” makes it more difficult to prosecute drugged driving.

Note to Pennsylvania readers: The existing Pennsylvania DUI laws already have the measures proposed in Kentucky.
